By law, if you operate a business in Australia you must register your business under a business name with the Office of Fair Trading in the state of business you are operating in. It is an offence to use an unregistered business name in Australia (some states may vary on this regulation).
Also if you want to register a business name in NSW and do business also in QLD you have to register the business name in QLD as well.
If you are using your own name, that is, your given names and/or initials followed by your surname without any addition, you do not need to register a business name. If you decide to add anything to your own name, for example “Sam Smith welding”, “SM Site Construction” or “SM and Associates”, you must register a business name.
Why you should register a business name
- It’s a requirement under the Business Names Act
- Registration helps you establish a business identity and gives you credibility. It shows a level of commitment for your business and new customers and suppliers are more likely to do business with you if you are registered with the office of fair trading
Business name registration also helps you know who you are dealing with in terms of your business customers and the suppliers you use.
